Terms of Use

1) Acceptance of These Terms

These Terms of Use (“Terms”) govern your access to and use of Aviationnica (the “App”). By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.

2) Definitions

“Content”: Includes any text, data, calculations, outputs, tools, calculators, reference material, visual elements, and other information made available in the App.
“Subscription”: Refers to the paid, auto-renewing annual access plan offered via Apple’s In-App Purchase system.
“Developer”: Refers to the publisher of Aviationnica.

3) License and Permitted Use

Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded products for personal, non-commercial use.

You may not:

Copy, modify, or create derivative works of the App.
Reverse engineer or attempt to derive source code.
Use the App to provide services to third parties (dispatch support, etc.) without written permission.

4) Intellectual Property

The App, design, assets, code, and trademarks are owned by the Developer and protected by intellectual property laws. All rights not expressly granted are reserved.

5) Aviation / Operational Use Prohibited

Aviationnica is provided strictly for educational and informational purposes. The App is NOT certified or approved for operational use. It must not be used for flight planning, fuel calculation, navigation, or safety-critical decisions. Any operational use is at your own risk.

6) Supremacy of Official Publications

Official, current, and approved aeronautical sources (AFM/POH, MEL/CDL, NOTAMs, ATC clearances) always supersede the App.

7) Disclaimer of Warranties

THE APP IS PROVIDED “AS IS”. THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING ACCURACY, COMPLETENESS, OR RELIABILITY. Aviation calculations may contain errors or outdated information.

8) Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the App, especially in operational contexts.

9) Indemnification

You agree to indemnify and hold harmless the Developer from any claims arising out of your misuse of the App or violation of these Terms.

10) Subscription, Billing, and Renewal

Subscriptions are processed by Apple. Payment is charged to your Apple ID account. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

11) Refunds and Cancellations

Refund requests are handled exclusively by Apple. The Developer cannot issue refunds directly.

12) Updates, Changes, and Availability

The Developer may modify or discontinue features at any time. Continued use of the App after Terms update constitutes acceptance of the new Terms.

13) Acceptable Use and User Conduct

You agree not to violate laws, infringe rights, or disrupt the App’s operation.

14) Third-Party Services and Content

The App may reference standards (ICAO, FAA, EASA) or third-party resources. The Developer is not responsible for their accuracy.

15) Apple Platform Acknowledgement

You acknowledge that these Terms are between you and the Developer, not Apple. Apple has no obligation for maintenance or support.

16) Termination

The Developer may terminate access if you violate these Terms. Upon termination, you must stop using the App.

17) Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. Exclusive jurisdiction lies with the courts and enforcement offices in İstanbul, Türkiye.
