These Terms of Use govern your access to and use of GymWize, including the mobile application, website, content, features, services, digital materials, exercise information, workout tools, progress tracking features, and any related functionality.

By downloading, accessing, or using GymWize, you agree to these Terms of Use. If you do not agree, do not use GymWize.

Acceptance of Terms

By using GymWize, you confirm that you have read, understood, and agreed to be bound by these Terms of Use and any additional policies referenced within them.

If you use GymWize on behalf of another person or organization, you confirm that you have the authority to accept these Terms on their behalf. If you do not agree with these Terms, you must immediately stop using GymWize.

Eligibility

You must be legally permitted to use GymWize in your jurisdiction. If you are under the age required by applicable law to enter into these Terms, you may use GymWize only with the consent and supervision of a parent or legal guardian.

GymWize is not intended for unsupervised use by children. Parents and guardians are responsible for determining whether GymWize and any related physical activity are appropriate for minors.

Description of Service

GymWize is a fitness and workout companion that may provide features such as:

• Exercise browsing;
• Workout routines;
• Warm-up and cool-down content;
• Mobility or recovery routines;
• Progress tracking;
• Workout history;
• Exercise summaries;
• Fitness goals;
• Equipment selection;
• Favorite exercises;
• Activity streaks;
• Awards or achievement features;
• Body measurement tracking;
• General fitness information;
• Personalized app experience based on user inputs.

Features may vary by version, region, device, subscription status, operating system, or availability.

Not Medical Advice

GymWize is not a medical device, healthcare service, physical therapy service, rehabilitation service, nutrition service, diagnostic tool, treatment tool, or emergency service.

All content provided by GymWize is for general informational and educational purposes only. GymWize does not provide medical advice, clinical advice, professional diagnosis, treatment, prevention, cure, therapy, rehabilitation, or medical monitoring.

You should consult a qualified physician, healthcare provider, physical therapist, certified trainer, or other appropriate professional before starting or changing any fitness program, especially if you have a medical condition, injury, pain, disability, pregnancy, recent surgery, medication use, or any health concern.

Assumption of Risk

Physical exercise involves inherent risks. These risks may include soreness, fatigue, strains, sprains, falls, injuries, aggravation of existing conditions, cardiovascular events, or other serious harm.

By using GymWize, you knowingly and voluntarily assume all risks associated with exercise, physical activity, equipment use, workout routines, stretching, mobility work, warm-ups, cool-downs, and any related activities. You agree that you are solely responsible for your own health, safety, decisions, actions, and results.

User Responsibility

You are solely responsible for determining whether any workout, exercise, movement, intensity, duration, repetition, set, rest period, difficulty level, equipment use, or recommendation is suitable for you.

You agree to: use proper form and technique; exercise within your personal limits; stop immediately if you feel pain, dizziness, shortness of breath, chest discomfort, faintness, or abnormal symptoms; use safe and properly maintained equipment; exercise in a safe environment; seek professional guidance when needed; avoid movements that are unsafe for your condition; and not rely solely on GymWize for health or safety decisions.

GymWize does not monitor your physical condition in real time and cannot determine whether you are exercising safely.

No Guaranteed Results

GymWize does not guarantee any specific result. No statement, feature, workout, score, achievement, recommendation, visual, or progress indicator should be interpreted as a promise that you will lose weight, gain muscle, improve strength, increase endurance, improve mobility, recover from injury, prevent injury, improve health, or achieve any specific fitness outcome.

Results depend on many personal and external factors, including consistency, nutrition, sleep, genetics, medical history, training history, stress, age, body composition, equipment, lifestyle, and professional guidance.

License to Use GymWize

Subject to your compliance with these Terms, you are granted a limited, personal, non-exclusive, non-transferable, revocable license to use GymWize for personal, non-commercial purposes. You do not acquire ownership of GymWize, its content, design, software, trademarks, graphics, exercise materials, visual assets, code, databases, or intellectual property. All rights not expressly granted are reserved.

Prohibited Use

You agree not to:

• Use GymWize for unlawful purposes or in a way that violates these Terms;
• Copy, modify, distribute, sell, rent, lease, sublicense, or exploit GymWize;
• Reverse engineer, decompile, disassemble, or attempt to extract source code;
• Interfere with app security or functionality;
• Use automated systems to access, scrape, or copy content;
• Misrepresent your identity or upload harmful, misleading, or unauthorized content;
• Use GymWize to provide professional training, medical, therapy, or coaching services without proper authorization;
• Attempt to bypass subscriptions, payment systems, or access controls.

User Content and Data

If GymWize allows you to enter, upload, save, or generate content or data, you remain responsible for that content or data. You represent that you have the right to provide any information you enter into GymWize.

You grant GymWize a limited right to process such information only as necessary to provide app functionality, improve services, maintain security, and operate GymWize according to the Privacy Policy. GymWize is not responsible for user-entered information that is inaccurate, incomplete, unauthorized, unlawful, or harmful.

Account and Device Responsibility

If GymWize uses accounts, device storage, cloud synchronization, subscriptions, or app store accounts, you are responsible for maintaining the security of your device, login credentials, app store account, cloud account, and any connected services. You are responsible for all activity that occurs through your device or account.

Purchases, Subscriptions, and Payments

GymWize may offer free features, paid features, subscriptions, in-app purchases, or premium access. If purchases or subscriptions are offered, they are processed through the relevant app store or payment provider. Payment terms, renewal rules, cancellation procedures, refunds, taxes, and billing issues may be governed by the app store or payment provider.

Subscriptions may automatically renew unless cancelled according to the rules of the platform where the subscription was purchased. GymWize does not directly control app store billing systems and may not be able to issue refunds directly. Refund requests may need to be submitted through the relevant app store or payment provider.

Changes to Features and Availability

GymWize may be updated, modified, suspended, limited, discontinued, or changed at any time without prior notice. Features may be added, removed, renamed, redesigned, restricted, or made paid. GymWize does not guarantee that any feature will always be available, error-free, uninterrupted, compatible with all devices, or available in all regions.

Accuracy of Information

GymWize aims to provide useful and clear fitness-related information, but no guarantee is made that any content is accurate, complete, current, safe, suitable, or error-free. Exercise information may not account for your personal circumstances, medical history, limitations, equipment condition, environment, or technique. You should verify important information independently and consult qualified professionals when appropriate.

Third-Party Services

GymWize may use or interact with third-party services, platform providers, cloud services, analytics systems, payment processors, app stores, device services, or external links. GymWize is not responsible for third-party content, services, policies, data practices, availability, errors, security, or decisions. Your use of third-party services may be subject to separate terms and privacy policies.

Intellectual Property

All rights, title, and interest in GymWize, including its name, logo, design, layout, software, code, graphics, icons, text, exercise materials, visual content, databases, features, and related materials, are owned by or licensed to the operator of GymWize. You may not use GymWize branding, content, or intellectual property without prior written permission.

Disclaimer of Warranties

GymWize is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, GymWize disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, safety, compatibility, and uninterrupted operation. GymWize does not warrant that the app will meet your expectations, produce any result, be free from errors, operate without interruption, or be safe for your specific physical condition.

Limitation of Liability

To the maximum extent permitted by law, GymWize, its owner, developer, publisher, affiliates, contractors, service providers, and contributors shall not be liable for any direct, indirect, incidental, consequential, special, punitive, exemplary, or other damages arising from or related to your use of or inability to use GymWize.

This includes, without limitation, damages related to: personal injury; physical harm; health consequences; exercise-related injuries; equipment-related injuries; incorrect exercise performance; reliance on app content; loss of data; loss of profits; subscription issues; service interruption; device malfunction; third-party services; user error; unauthorized access; inaccurate information; or failure to achieve fitness results. You agree that your use of GymWize is at your own risk.

Indemnification

You agree to defend, indemnify, and hold harmless GymWize, its owner, developer, publisher, affiliates, contractors, service providers, and contributors from and against any claims, damages, losses, liabilities, costs, expenses, or demands arising from: your use or misuse of GymWize; your violation of these Terms; your violation of any law or third-party right; your exercise activity or physical injury; your reliance on GymWize content; your user-entered information; your use of equipment or training environments; or your failure to seek professional advice when appropriate.

Termination

GymWize may suspend or terminate your access to the app or certain features if you violate these Terms, misuse the app, create risk, interfere with operation, or if continued access is no longer commercially or legally feasible. You may stop using GymWize at any time. Sections intended to survive termination, including disclaimers, limitation of liability, intellectual property, indemnification, and governing law, will continue to apply.

Updates to Terms

These Terms may be updated from time to time. Updates may reflect legal changes, feature changes, business changes, technical changes, or policy changes. The updated Terms will be posted on the official website or made available through GymWize. Continued use of GymWize after the updated Terms become effective means that you accept the updated Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and interpreted according to the laws of the Republic of Türkiye, unless mandatory consumer protection laws in your country require otherwise. To the extent permitted by law, disputes arising from or related to GymWize shall be subject to the exclusive jurisdiction of the courts and enforcement offices of İstanbul, Türkiye.
